MOBILE BANKING
Terms and Conditions for Mobile Banking Services
· Definitions: The following words and expressions shall have the corresponding meanings wherever appropriate.
· ‘Account’, shall mean any account at the Bank which has been registered for use via the Mobile Banking Service.
· ‘Bank’ shall mean State Bank of India or any successor or assign.
· ‘Customer’ the holder of a Bank account in SBI.
· ‘MPIN’ shall mean the Personal Identification Number (password) for the mobile banking services.
· ‘Facility’ shall mean mobile banking facility provided to the customers.
· ‘Mobile Phone number’ shall mean the mobile number that has been used by the customer to register for the Facility.
· ‘Application’ shall mean the mobile banking application which will be downloaded onto the mobile phone of the Customer.
Applicability of Terms and Conditions
By using the Mobile Banking Services, the Customer thereby agrees to these Terms and Conditions of the service. These terms and conditions form the contract between the Customer and Bank and Mobile Banking Services of the Bank shall be governed by such terms as amended by the Bank from time to time. These terms and conditions shall be in addition to and not in derogation of other terms and conditions relating to any account of the Customer and/or the respective product or the service provided by the Bank.
Business Rules Governing Mobile Banking Services
The following business rules will apply on MBS being offered by the Bank
1. The facility will be available to customers having a satisfactory running account at Core Banking Branches.
2. The customer must have been issued a SBI Debit Card linked to such running bank account, which is active and operational.
3. The eligible customer will have to register for the service with the Bank using SBI Debit Card number and SBI Debit Card PIN number. There is no need for the customer to fill in any physical registration form, visit branch, ATM or Internet site of the Bank for the purpose. The customer will only need to send an SMS with prescribed keyword at short code number and Bank will arrange to enable mobile banking application for the customer.
4. The upper ceiling per transaction limit shall be Rs. 5000.00 within an overall calendar month limit of Rs. 25,000.00.
5. Three wrong MPIN entries will block the MBS to the account for the day and two consecutive blockages will remove the data from the mobile banking application in the handset. The customer will have to re-register for the service following the registration process explained above, should he/she desire to continue to avail the services from the State Bank of India.
6. Any change in the business rules of any of the processes will be notified on Bank’s website, which will be construed as sufficient notice to the customer.
7. In the case of a joint account, the account holder who has been issued the Debit Card will be eligible to avail the facility. All or any transactions arising from the use of the Facility in joint accounts shall be binding on all the joint account holders, jointly and severally. Accounts of minors where Debit card has been issued will also be eligible for the Facility.
Registration:
Eligible Customers will register through the mobile by downloading the mobile banking application on to their handset and following the instructions for registering. They can also register by other methods as provided by the Bank from time to time. The Customer will have to submit his/ her Debit Card number and the PIN for registration. The Customer will be eligible to use the Facility only after the Debit Card and PIN are authenticated by the Bank. The Bank reserves the right to reject a Customer’s application for Mobile Banking Services without giving any reasons.
Usage of Facility:
By accepting the terms and conditions on the mobile phone while registering for the facility, the customer:
1. Agrees that he/she will use the mobile banking services for financial and non-financial transactions offered by the SBI from time to time.
2. Also irrevocably authorizes the Bank to debit his/ her bank accounts which have been prescribed by him/her at the time of registration for all transactions/services undertaken using MPIN.
3. Authorises the Bank to map his account number, SBI Debit Card number and mobile phone number for the smooth operation of mobile banking services offered by the SBI. He/ she also authorises the Bank to preserve the mapping record in its own server or server of any other third party and to use such data at its discretion for providing/enhancing further banking/ technology products that it may offer.
4. Agrees that he/ she is aware and accept that mobile banking services offered by the bank will enable him/her to execute any financial transaction using MPIN within the limit prescribed by the Bank and will be deemed as bonafide transaction.
5. Agrees that the transactions originated using the mobile phones are non retractable as these are instantaneous.
6. Understands and explicitly agrees that Bank has the absolute and unfettered right to revise the prescribed ceilings from time to time which will be binding upon him/her.
7. Agrees that the facility entitles him/her to use only a mobile phone registered in his/her name with the Mobile Service Provider and undertakes to use the Facility only through the registered mobile number which has been used to register for the Facility.
8. While the encryption technology (256 bits) being used is in conformity / higher than the industry standards, it does not comply with that stipulated by IT Act, 2000 which envisages the use of digital signatures.
Others
1. The account which is the primary account linked to the Debit Card will also be the primary account for the Facility. The other accounts which have the same Customer Identification Folio (CIF) as the primary account will also be accessible through the Facility.
2. The Customer shall be required to acquaint himself with the process for using the Facility and the Bank shall not be responsible for any error made by the Customer while using the Facility.
3. The Bank reserves the right to decide what services may be offered, making additions/ deletions to the services offered under the Facility at its sole discretion.
4. The instructions of the Customer shall be effected only after authentication of the Customer by verification of his/her USER ID and MPIN or through any other mode of verification as may be stipulated at the discretion of the Bank.
5. It shall be the endeavour of the Bank to carry out the instructions received from the Customers promptly. However, the Bank shall not be responsible for the delay/ failure in carrying out the instructions due to any reason whatsoever including failure of operational system or due to any requirement of law. The Customer expressly authorizes the Bank to access his/her account information required for offering the services under the facility and also to share the information regarding his/ her accounts with the service provider/ third party as may be required to provide the services under the Facility
6. The transactional details will be recorded by the Bank and these records will be regarded as conclusive proof of the authenticity and accuracy of transactions.
7. The Customer hereby authorizes the Bank to send promotional messages including the products of the Bank, greetings or any other messages the Bank may consider from time to time. The Customer agrees, unconditionally and irrevocably, that such messages/ calls made by the Bank or its agents will not be considered as a breach of privacy.
8. The Customer understands that the Bank may send rejection or can not process the request messages for the service request(s) sent by the Customer whichcould not be executed for any reason.
9. The Bank shall make all reasonable efforts to ensure that the customer information is kept confidential.However, the Bank shall not be responsible for any inadvertent divulgence or leakage of confidential Customer information for reasons beyond the control of the Bank.
10.The Customer expressly authorizes the Bank to carry out all requests/ transactions purporting to have been received from his/ her mobile phone and authenticated with his/ her MPIN without having to verify the authenticity of every request / transaction.
11.In the case of payment facilities like bill payment, the customer shall be deemed to have expressly authorised the Bank to make the payment when a request is received from him/ her.
12.It is the responsibility of the Customer to advise the Bank of any change in his mobile number or loss/ theft of his mobile phone by adopting the procedure laid down by the Bank for the purpose.
Fee structure for the Facility:
The Bank reserves the right to charge the Customer a fee for the use of the services provided under the Facility. The fee structure shall be subject to change at the Bank’s discretion. Display of such charges on websites would be sufficient notice to the Customer. The same is binding on the customer.
Accuracy of Information:
1. It is the responsibility of the Customer to ensure the correctness of the information supplied by him/ her to the Bank through the use of the Facility or any other method. In case of any discrepancy in this information, the Customer understands that the Bank will not be in any way responsible for action taken based on the information. If an error in the information supplied by the Customer is reported to the Bank by the Customer, the Bank will endeavour to correct the error promptly wherever possible on a best effort basis.
2. The Customer understands that the Bank will try, to the best of its ability and effort, to provide accurate information. However, the Customer shall not hold the Bank responsible for any errors or omissions that may occur due to reasons beyond the control of the Bank.
3. The Customer accepts that the Bank shall not be responsible for any errors which may occur in spite of the steps taken by the Bank to ensure the accuracy of the information and the Customer shall not have any claim against the Bank in an event of any loss/ damage suffered by the Customer as a consequence of an inaccurate information provided by the Bank.
Responsibilities and obligations of the customer
1. The customer will be responsible for all transactions made through the use of his/ her mobile phone, SIM card and MPIN, regardless of whether such transactions are in fact entered into or authorized by him/ her.
2. The Customer shall take all steps possible to ensure that his/her mobile phone is not shared with anyone and shall report any misuse/ loss of the mobile phone or SIM card immediately.
3. The Customer will access the mobile banking application using his/ her USER ID which will not be disclosed to anyone.
4. The Customer will use the services offered under Facility using the MPIN in accordance with the procedure as laid down by the Bank from time to time.
5. The Customer shall keep the USER ID and MPIN confidential and will not disclose these to any other person or will not record them in a way that would compromise the security of the services.
6. It will be the responsibility of the Customer to notify the Bank immediately if he/ she suspects that the misuse of the MPIN. He will also immediately initiate the necessary steps to change his MPIN.
7. The Customer shall immediately notify the Bank if the mobile phone or SIM is lost to suspend the mobile banking services.
8. The Customer will be responsible for any kind of fraudulent or erroneous instructions given from his / her mobile phone and /or SIM card using the MPIN and any financial loss/ charges thus incurred will be payable by the Customer.
9. The Customer accepts that any transaction originating from the USER ID and / or registered mobile phone number shall be assumed to have been initiated by the Customer.
10.The Customer shall keep himself/herself updated with regard to any information/ modification relating to the services offered under the Facility which would be publicized on the websites and at the branches. The Bank shall not be responsible if the Customer fails to do so.
11.The Customer shall be liable for all loss if he/she has breached the Terms and conditions contained herein or contributed or caused the loss by negligent actions or a failure on his/her part to advise the Bank within a reasonable time about any unauthorised access in the account.
Termination of Facility:
The Customer can request for termination of the Facility by sending appropriate message through the mobile banking application on the handset. Notwithstanding the termination of the said facility, the Customer shall remain accountable for all the transactions made prior to confirmation of any such cancellation request on the Customer’s account.
The Bank may, at its discretion, withdraw temporarily or terminate the Facility, either wholly or in part, at any time without giving prior notice to the Customer.The Facility may be suspended for any maintenance or repair work or in case of any emergency or for security reasons. The Bank shall endeavour to give a reasonable notice for withdrawal or termination of the Facility but shall not be responsible if such an action has to be taken for reasons of security or emergency.
The services offered under the Facility will be automatically terminated if the accounts linked to the Debit Card used for registration of the Facility are closed. The Bank may also terminate or suspend the services under the Facility without prior notice if the Customer has violated the terms and conditions laid down by the Bank or the death of the Customer are brought to the notice of the Bank. The Bank shall suspend the registration of any Customer if the Facility has not been accessed by the Customer for three months or more. If the Facility has not been accessed for six months or more, the registration of the Customer will be cancelled.
